Arizona V. Gant Opinions?

What do you think about the case, good decision or bad? Why? I will give my opinion when I am able to get my laptop back, it broke so probably a few days.

What you didn't even answer the question! Here is my answer, I think they made the right decision. There is no reason for an officer to seach the car if the suspect is in the back of the police car, handcuffed, with the door locked. What is the reason for the search after that point, there isn't one! However, if you arrest someone for drunk driving, you can search the vehicle for booze because you might be able to find evidence of the crime you arrested them for, so I understand and agree with this decision.

I think the search should be made and it should be in sight of the prisoner. Helps prevent the ''they planted evidence'' cry when something is found in the car back at the station.

It does however, there are still going to be suspects that say we "planted" evidence when we get to court! I think the search should be made only if it could find Evidence of the crime in which you arrested a suspect for. If you arrested him for operating while suspended, you aren't really going to find evidence of that, and you already have them arrested so no officers safety issue.

Doubletap, obviously the laws are different over here in the civilised world.

We are not so obsessed with the only searching for evidence regarding the arrest offence. If I arrest for say, drink drive, I'd search the car for drugs or weapons etc.

I don't really like the ruling either. It just seems like another way to protect guilty people from further charges being brought up against them.

We are not obsessed with only searching for evidence regarding the arrest offense either, however, our courts are. We have this thing called the constitution and they actually make us follow it...it sucks! They (the courts) say that we have to follow certain procedures in order for the states (governments) case to hold up in court.
