Blair Holt's Firearm Licensing and Record of Sale Act of 2009
To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes.

OpenCongress Summary:
The Blair Holt's Firearm Licensing and Record of Sale Act would establish a nationwide system for prohibiting unlicensed gun-ownership. If approved, the law would require gun owners to apply for five-year licenses to own firearms, and would give the U.S. Attorney General broad authority over the program. There are no co-sponsors to the bill, and there is very little chance it will be adopted.

Blair Holt's Firearm Licensing and Record of Sale Act of 2009 - Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.
Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.
Prohibits:
(1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions;
(2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act;
(3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours;
(4) failing to report to the Attorney General an address change within 60 days; or
(5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.
Prescribes criminal penalties for violations of firearms provisions covered by this Act.
Directs the Attorney General to:
(1) establish and maintain a firearm injury information clearinghouse;
(2) conduct continuing studies and investigations of firearm-related deaths and injuries; and
(3) collect and maintain current production and sales figures of each licensed manufacturer.
Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

umm... guys? I have a license to own a firearm. it isn't a big deal. they just implemented a system where having a F.O.I.D. card (Firearm Owner's IDentification card) lasts for 10 years, not 5.
I don't know about the rest, but, IN MY PERSONAL OPINION...
if you can't get a license, you shouldn't have firearms.
I am aware that Illinois is one of the only states that has an official licensing system, but, there are other benefits to it
For one, the FOID card is an official form of state-ID. its got your photo and your name among other information on it... so it is quite useful!
Again, not speaking on any of the other topics, but I personally feel that the licensing system in the state of Illinois is very good at weeding out people who should not have firearms.
(specifically, people who have broken the law, been judged as mentally defective/unstable, or who are not legal citizens)
Just wanted to give my .02
If anyone has any questions about the Illinois licensing system, feel free to ask and I will gladly answer. I am well versed in my state's laws and codes.

I would like to comment some of the aspects of this bill, line by line.
Re: (1) In Illinois this is precisely how it works already. Anyone who transfers a firearm to a non-licensed individual is basically a weapons dealer. Firearms distributors that are licensed by the state to sell Firearms have access to National Instant Criminal Background Checks for a damn good reason. There is a 3-day waiting period for a damn good reason. Additionally, every time you purchase a firearm in Illinois, the licensed distributor of firearms calls the State Police to ensure that your FOID card is still valid and that you are not a fugitive from justice, etc etc
Re: (2) duh. this isn't complicated.
Re: (3) Okay, so, if you own a firearm, and it is stolen from you, (or if you are a licensed distributor..) you sure as hell better have the brains to contact law enforcement right away. I fail to see how this is a problem. This particular line is doing what law is supposed to do: enforcing common sense. It would probably take a lot less than 72 hours for one or more lives to end if your gun is taken from you.
Re: (4) if you have a problem with this, it means you shouldn't own a firearm
Re: (5) I'm not even going to comment on this because there is someone who already commented on it. His name was Charles Darwin.
I'm going to go ahead and assume that most people who had a problem with this particular bill did not like (1)
The fact of the matter is that the ATF exists for a reason. All firearm purchases and transfers are, or at least should be, conducted with their knowledge.
I am a firm believer in the idea that if you are doing something that is right, there should not be a problem with someone else knowing about it.
I don't have a problem with the fact that my government knows precisely what handguns i own, have transferred, and to who. As far as i'm concerned, they should.
feel free to discuss any of these points. I had some free time and I personally feel that every state should have licenses for owning firearms. I hope this bill passes.
As for microstamping bullets... thats another story that can burn in hell

The fact of the matter is that they already do a background check when you pruchase a firearm. That check checks for felonies, Domestic batteries, habitual drug user, and mental deficeincy.
Why should I have to go and get a card that does all that THEN have to fill out paper work to buy a gun and have the same check done AGAIN?
It is just a way the feds have to try and get more of my hard earned money. It is a solution to a problem we do not have.

Exactly!!! Swattie, I look at it like, someone talking on their cell phone...some states pass laws that prohibit individuals from doing that, but in that exact same state they have a "Inattentive Driving" statute. If you would just enforce the Inattentive driving statute you wouldn't have to have the cell phone laws! The feds and the state authorities need to enforce the laws already on the books!!!

While I understand your position on the issue of National Instant Background Checks already being done, and having to do paperwork twice, etc...

these 5 lines have nothing to do with that.
And, as a matter of fact, these rules apparently aren't in place in states other than mine.
So yeah, as far as i can see, these should be in place.
The one that really pisses me off is that lawmakers have to write a LAW to say "REPORT YOUR STOLEN GUN". That is almost as bad as the law that forces people to wear their seatbelts.

these 5 lines have nothing to do with that.
My response , in order.
1) So you don't want to be able to pass your gun to you child unless you pay a dealer to do it?
2) Just a way to say "Big Brother is watching you"
3) I would report it to the police, why should I have to report it AGAIN to the AG?
4) Why do they want to be able to take my guns and need to know my current address to do so?
5) I was raised around guns all of my life. They sat in the corner of the house, LOADED. I never touched a gun without permission. I believe if people would make their kids aware of what they can do then there wouldn't be such a facination with them.

I was also raised around guns my whole life, and I never touched them unless told I could. What I want to know is, why would they make them Inaccessable and not loaded, how does that work when I have someone break into my house and I have to protect my family. I can't stop the bad guy and say "Hey, one minute while I put the combination in my safe, or stick a key in the hole (under pressure, VERY hard to do!).
